Michigan Legalizes Delta 8 THC

Delta-8 THC is making waves again! If you’re well-versed in cannabis, you already know about the many different THCs (tetrahydrocannabinols) that exist in cannabis sativa. The most popular form of THC being Delta-9 which gives users the medicinal and spiritual benefits that are commonly known. However, there are other forms of THC that exist in cannabis sativa that were recently legalized on the federal level with the 2018 Farm Bill. Wisconsin also legalized those compounds with Wisconsin Statute 94.55.

These other forms of THC induce a feeling almost identical to Delta-9 THC and have become a hot topic among states with current legalization for Delta-9 THC. According to the Michigan Marijuana Regulatory Agency:

“Delta-8 is a cannabis compound that has become popular because of its similarity to delta-9. Both delta-8 and delta-9 are cannabinoids and are similar in both their names and their chemical structures. THC is the part of the marijuana plant that produces the “high” associated with marijuana; the scientific name for THC is delta-9-tetrahydrocannabinol, or delta-9 THC, or just delta-9. Delta-8 is short for delta-8-tetrahydrocannabinol, or delta-8 THC. Delta-8 causes effects for users similar to regular delta-9.”

Earlier this summer, Michigan joined a handful of states with legalized Delta-9 THC in banning Delta-8 THC due to their inability to regulate and tax these products under their current legislation.

On October 11, 2021, Michigan state legislature signed Bill 4517 into law, declaring the legalization of all products with a THC concentration over 0.3%. The Michigan Marijuana Regulatory Agency will oversee all THC products, including Delta-8 THC. You will need a state license to manufacture and sell Delta-8 THC in Michigan.

This is good news for the industrial cannabis industry which has found itself defending its valuable THC products with claims likening Delta-8 THC to “bath salts” and “spice.” Delta-8 THC continues to be a viable and legal option for consumers who are residing in states where recreational and medical cannabis products are not legal.

And now even “legal” states like Michigan are recognizing the amazing effects of Delta-8 THC in comparison with the more well-known Delta-9 THC.

Is Delta-8 THC safe?

There are no current studies on the long-term effects of Delta-8 THC. Delta-8 THC is currently unregulated in Wisconsin so it is extremely important that you educate yourself as the consumer on which products you are consuming. Here are some things to look for when shopping for Delta-8 THC and other exotic THC compounds:

  • Independent lab-testing (ideally with unique batch-testing) for each product.
  • Scannable QR codes that link you directly to third-party lab results.
  • Fully ceramic or ceramic-coil vape cartridges to ensure you are not inhaling heavy metals or chromium as part of the vaporization experience.
  • Clear ingredient-labeling for edible products.
  • Vapor products should be free of fillers such as vegetable glycerin, vitamin E acetate and propylene glycol which can be commonly used to alter the viscosity of inferior-quality distillates.
  • Buy from reputable stores and dispensaries with helpful staff members that can answer any questions or concerns you have regarding the products they are trying to sell you.
